Cruise Spirit Terms & Conditions


HOW TO BOOK:

We recommend booking well in advance by sending a non-refundable deposit up $1400 per person. Some cruises may require a higher deposit of up to 50% to meet cruise line booking conditions. These details will be provided on application. The deposit is required within 7 days of confirmation to hold the reservation. The booking confirmation will include the exact deposit amount required and the due date of final payment. Receipt of deposit will be taken as an understanding by the Company that the participant has checked their confirmed travel arrangements and has read and agrees to abide by the terms and conditions set forth in this brochure. Any verbal quote given is an estimate only of the price which will be subject to advice on confirmation of reservation. Final payment is due 76 days prior to departure. If your deposit is not received within the 7day option period your booking will be automatically cancelled. Bookings are not complete until Adventure World receives full payment along with a completed “Booking Form”. Cheques are made payable to “Adventure World”. Travel documents will be issued approximately 3 weeks prior to departure

PRICE GUARANTEE:

Prices in this brochure are based on costs as at 2 March 2005. Should these costs change, it may be necessary to make a surcharge on the price of your holiday. However no surcharge in respect of costs or currency fluctuations will be made to the land arrangement of your holiday once full payment has been received by Adventure World. This does not apply to any taxes, charges, or levies imposed by any government or their agencies. The air content is based on airfares applicable as at the above date. As airline prices are constantly changing, it may be necessary to impose an air surcharge any time up to departure.

CANCELLATIONS AND REFUNDS ON CRUISE/LAND ARRANGEMENTS:

It if is necessary to cancel your holiday arrangements the following cancellation fees per person will apply in addition to the applicable cancellation fees from relevant cruise, land operators:

  • More than 76 days before departure -   $250 per person
  • Within 75 days of departure -   $330 per person

Cancellations fees for some product in this brochure may vary from those stated above. Please check with Adventure World at time of booking. Regrettably, cancellation charges cannot be waived. There will be no exceptions. No refunds apply after departure from origin. Please note that employees of any overseas supplier are not authorised by Adventure World to make any undertakings to our clients in respect of refunds or other matters.

CANCELLATIONS AND REFUNDS AIR ARRANGEMENTS:

Cancellation fees will apply as required by Airline regulations and will vary dependent upon the type of airfare utilised. Airfare prices and conditions are subject to change or withdrawal without notification until ticketed. Full payment is required before tickets can be issued. Adventure World cannot be held liable for any increases in prices or changes in the rules and conditions. Foreign currency airfares and airport taxes may fluctuate and are subject to the rate of exchange on date of ticket issue. Increases in airport taxes are not the responsibility of Adventure World and can be imposed up to departure

NOT INCLUDED IN FLY/CRUISE HOLIDAY PRICE:

Transfers, non prepaid airport taxes and levies, international departure taxes, visas, insurance, excess baggage, extra meals, laundry, drinks, souvenirs, items of a personal nature including medication. All prepaid airfare taxes and surcharges are clearly identified if not included in the tour price. An additional 1% credit card service fee will be applied to the dollar amount paid by MasterCard, Visa or Bankcard.

CHANGE IN PRICES AND ITINERARIES:

Considerable care has been taken to compile the information in this brochure but circumstances may necessitate change in itineraries and prices in which case you will be informed as soon as possible. Adventure World cannot be held responsible for any change, which may occur and reserves the right to increase the price of any travel arrangement up to the date of departure. This includes adjustment for devaluation fuel surcharges airfare increases as well as international exchange rate fluctuations.

HOLIDAY VARIATIONS:

If unforeseen circumstances beyond our control require us to make necessary changes to your holiday, we reserve the right to cancel or reschedule departures and itineraries.

SHIP DESCRIPTIONS, MAPS AND PHOTOGRAPHS:

Descriptions featured in this brochure as based on current guides and contractual agreements provided by suppliers. Any facilities described are subject to change at any time. Maps and photographs are included for general information and may not necessarily reflect actual routings, location or services. Cabin accommodation photographs may not be specific to the actual room occupied.

INSURANCE:

It is a condition of booking one of our tours that travellers must be adequately insured for the full duration of their tour in respect of illness, injury, death, loss of baggage and personal items, cancellation and curtailment. Your travel agent will be able to offer a suitable holiday insurance policy.

AIRLNES:

The airlines do not by virtue of their endorsement of the brochure represent themselves either as contracting with any purchaser of a holiday from Adventure World or as having any legal relationship with such a purchaser.

PASSPORT, VISA AND VACCINATIONS:

It is mandatory that you familiarise your self with any visa and health requirements that may be applicable in the countries you are visiting. You are responsible for all entry exit health and any other documents required by laws regulations orders demands or requirements of countries visited or transited. Please note that passport and visa requirements are not the responsibility of Adventure World or that of your travel consultant both parties can not be held liable for any loss or expense due to the failure to comply with the above.

CONSULAR ADVICE:

Official travel advice issued by the Australian Department of Foreign Affairs and Trade is available by calling (in Australia) 1300 555 135 or visiting their website www.dfat.gov.au. We recommend that you review this information both prior to making your booking and prior to departure.

UNLICENSED ENTITY DISCLAIMER:

If you request Adventure World to arrange for the provision of products or services by a person or company which is not licensed in accordance with any applicable law Adventure World accepts no liability (whether in contract for negligence or otherwise) for any loss or damage suffered by you as a result.

RESPONSIBILITY:

Cruise Spirit International is a trading division of Adventure World. Adventure World (herewith call the Company) accepts bookings subject to the following conditions

  • Adventure World acts as a co-ordinator for all persons taking the fly/cruise holiday in the making for all arrangements for transportation and hotel accommodations. Adventure World International does not own manage control or operate any ship, transportation vehicle, or any other supplier of services. All coupons, receipts and tickets are issued subject to the terms and conditions specified by the laws of the country where the services are provided.
  • A booking is accepted only after the Company receives the deposit and issue the client or their travel agent confirmation invoices. The balance must be paid no later than 60 days before departure otherwise the Company will treat the booking as cancelled regardless of whether a deposit is being held.
  • The Company only acts as an agent for the owners contractors and suppliers of transportation and / or other related travel services provided and assume no responsibility for the loss or damage to baggage property or for injury illness or death or for any damages or claims damage to person or property delays transport failures strikes wars and uprisings or acts of God etc over which we have no control. Clients are strongly advised to insure adequately for the full duration of their travel arrangements in respect of illness injury death baggage and personal effects.
  • While the Company will use its best endeavors to operate all tours as advertised reasonable changes in the itinerary may be made without notice where deemed necessary or advisable by the Company. No refund will be made for any unused services which are included in the tour price.
  • All matters rising to the services provided by the Company but not in respect of other things governed by the law of the state of New South Wales
